Booking terms and conditions

These terms and conditions govern the booking and participation in visits, tours and experiences offered by MARBELLA LIFE TOUR EXPERIENCE S.L, Tax Identification Number (NIF) B26921841, hereinafter referred to as Marbella Life Tour Experience.
By making a booking through our website, the customer declares that they have read and accepted these terms and conditions.
1. Bookings and payment
Bookings made directly through our website must be paid for in advance using the payment methods available at the time of booking.
The booking will be considered confirmed once payment has been successfully completed and the corresponding confirmation has been received.
Where a booking is made through an external platform such as GetYourGuide, Tripadvisor, Viator or other intermediaries, the applicable payment, amendment and cancellation terms shall be those established for the booking on the relevant platform.
2. Prices
The prices displayed on our website are those applicable at the time the booking is made and include all legally applicable taxes, unless expressly stated otherwise.
The price includes only the services specified in the description of each experience.
3. Cancellations by the customer
Bookings made directly with Marbella Life Tour Experience may be cancelled up to 24 hours before the scheduled start time of the activity, with the right to a refund of the amount paid.
Cancellations made less than 24 hours in advance, as well as failure to attend the activity, will not entitle the customer to a refund, unless Marbella Life Tour Experience decides otherwise due to exceptional and duly justified circumstances.
For bookings made through external platforms, the cancellation policy stated on the relevant platform shall apply.
4. Punctuality and meeting point
Customers must arrive at the meeting point indicated in their booking confirmation at the scheduled time.
In order to avoid inconveniencing the other participants, a maximum grace period of 10 minutes will apply. After this period, the activity may begin without the customer and their absence may be treated as a no-show, with no entitlement to a refund.
If the customer expects to arrive late, we recommend contacting us as soon as possible.
5. Weather conditions
Our tours mainly take place outdoors, and rain or unfavourable weather conditions do not necessarily result in the cancellation of the activity.
In the event of light rain or changes in weather conditions once the experience has begun, Marbella Life Tour Experience may adapt the route, temporarily change certain stops or propose reasonable alternatives in order to continue the activity under the best possible conditions.
Where forecasts indicate particularly adverse weather conditions that may significantly affect the operation or safety of the activity, we will contact customers to inform them and assess the available alternatives.
If Marbella Life Tour Experience ultimately decides to cancel the activity due to weather conditions and it is not possible to offer, or the customer does not accept, a reasonable alternative date or option, the amount paid for the cancelled activity will be refunded.
6. Changes to the itinerary
The descriptions, routes, timetables and establishments shown on our website represent the experience planned under normal circumstances.
However, certain circumstances beyond our control — including closures, public events, building works, access restrictions, venue availability or other similar situations — may make it necessary to alter part of the itinerary.
Marbella Life Tour Experience may make reasonable changes where necessary to ensure the proper running of the activity, while always seeking to maintain the quality, duration and essential nature of the experience booked.
7. Food and drink experiences
Some of our experiences include visits to food and drink establishments, tastings, tapas, wines, olive oils or other products.
The specific establishments or products offered may occasionally vary due to availability, closure, capacity restrictions or other circumstances beyond the control of Marbella Life Tour Experience. In such cases, we will endeavour to replace them with an alternative of similar characteristics and quality.
For this reason, we do not recommend including the names of specific establishments in these contractual terms and conditions, even where they are mentioned in the commercial description of a particular experience.
8. Allergies, intolerances and dietary requirements
Participants must inform us sufficiently in advance of any relevant allergies, food intolerances or dietary requirements.
We will make every reasonable effort to adapt the experience where feasible and will pass this information on to the relevant establishments. However, as these are third-party establishments and kitchens, we cannot guarantee the complete absence of traces of allergens or cross-contamination.
In the case of severe allergies, customers must inform us before taking part in the activity so that we can properly assess the available options for adaptation.
9. Alcohol consumption
Certain experiences may include alcoholic beverages.
Alcohol consumption is restricted to persons who meet the legal drinking age in Spain, and proof of age may be requested where necessary.
Non-alcoholic alternatives will always be offered or may be requested where beverages form part of the experience.
10. Minors
Minors must take part accompanied by a responsible adult, unless different conditions are stated in the description of a particular activity.
The accompanying adult will be responsible for supervising the minor throughout the activity.
11. Safety and liability
Participants must follow all reasonable instructions provided by the guide during the activity and behave responsibly.
Marbella Life Tour Experience will take all reasonable measures necessary to ensure that activities are carried out properly and safely.
The company shall not be liable for damage arising solely from reckless behaviour by a participant, failure to follow safety instructions or circumstances beyond its control, without prejudice to any liabilities that legally apply to Marbella Life Tour Experience and to any rights granted to consumers under applicable law.
Nothing in these terms and conditions is intended to exclude or limit any liability that cannot legally be excluded or limited.
12. Personal belongings
Each participant is responsible for their personal belongings during the activity.
Marbella Life Tour Experience shall not be responsible for the loss, misplacement, theft of or damage to personal belongings where such loss or damage is not attributable to the company.
13. Cancellation or amendment by Marbella Life Tour Experience
In exceptional circumstances, Marbella Life Tour Experience may cancel or modify an activity for reasons including safety concerns, illness or unexpected unavailability of the guide, restrictions imposed by public authorities, severe weather conditions, extraordinary events, force majeure or other circumstances that make the activity impossible or inadvisable.
Wherever possible, the customer will be offered an alternative date or an equivalent experience.
Where Marbella Life Tour Experience permanently cancels an activity and is unable to provide the booked service, the customer will be entitled to the corresponding refund, without prejudice to any other rights granted under applicable law.
14. Conduct during the activity
Marbella Life Tour Experience may refuse participation or ask any person to leave the activity where their behaviour may endanger their own safety, the safety of the group or the guide, or seriously disrupt the normal running of the experience.
This measure will only be taken where reasonably necessary.
15. Right of withdrawal
Tourism and leisure activities booked for a specific date or period of performance may fall within the exceptions to the general 14-day right of withdrawal provided for under consumer protection legislation.
Accordingly, where such an exception applies, cancellation of the booking will be governed by the policy set out in these terms and conditions and communicated to the customer during the booking process.
16. Bookings made through third parties
Where an activity is booked through an external platform, certain matters relating to payment, amendments, cancellations or refunds may be subject to the terms and conditions accepted by the customer on that platform.
Marbella Life Tour Experience has no control over the contractual terms imposed by such intermediaries.

18. Applicable law and consumer rights
These terms and conditions shall be interpreted in accordance with applicable Spanish law.
Nothing contained herein shall limit any rights to which the customer is entitled as a consumer or user under applicable legislation.
